Abstract:

Disinformation not only affects democracy and distorts the information order but has a significant impact on human rights as well, going beyond freedom of expression. This article argues for the need of adopting an international human rights law (IHRL) perspective to the analysis of disinformation. This framework of analysis allows both a full understanding of the impact that disinformation has on a wide range of human rights and the assessment of the compliance with human rights obligations of states and companies’ responses to disinformation. Lastly, IHRL also offers an important tool for lobbying on states and social media platforms, in order to develop better and more human rights-compliant responses to disinformation.
